About these terms

These terms cover your use of claritycommerce.io (the "site") and booking a call through it. Clarity Commerce is run by Christopher Lang in Apex, North Carolina, and is a trade name of Optimize Web Development, LLC. "We", "us" and "our" mean Clarity Commerce. "You" means anyone who uses the site.

By using the site, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the site.

What the site is

The site tells you about our work moving businesses to Shopify and building new Shopify stores. You can read it, get a free guide and book a free 15-minute call.

• The free call is a short conversation to see whether we're a good fit. There's no fee and no obligation.
• Nothing on the site is a promise of results, prices or timelines. Case study results describe what happened for one client and are not a guarantee of what will happen for you.
• The content, including the free guide, is general information. It isn't legal, tax or financial advice. Use your own judgment and check with your own advisers before acting on it.

Paid work

We never take on paid work through the site. Any paid work happens only under a written proposal and agreement that you sign. That signed agreement alone sets the scope, price, payment terms and everything else about the work. These terms don't apply to it, and if anything here conflicts with a signed agreement, the agreement wins.

Booking a call

• Please give accurate details when you book, and use your own name, email and phone number.
• To reschedule or cancel, use the link in your confirmation email or email us.
• We may decline or cancel a booking, for example if it looks like spam or the call clearly isn't a fit.
• Calls may be recorded and transcribed with AI note-taking tools, as described in our Privacy Policy. Tell us at the start if you'd rather not be recorded.

Intellectual property

The site and everything on it, including the text, design, logos, images, videos and the free guide, belong to us or to the people who licensed them to us. The Clarity Commerce name and logo are ours.

You're welcome to read the site, share links to it, print pages for your own reference, and use the free guide in your own business. You may not copy, republish, sell or rebrand our content, or present it as your own, without our written permission.

Other names on the site, like Shopify, Magento or WooCommerce, are trademarks of their owners. Mentioning them doesn't mean they endorse us.

Acceptable use

When you use the site, please don't:

• break any law, or use the site to harm anyone;
• submit false information or someone else's details, or pretend to be someone else;
• send spam or junk submissions through our forms or calendar;
• scrape or copy the site in bulk with bots or automated tools;
• try to hack, overload or disrupt the site, or get around its security or bot checks;
• upload or send viruses or other harmful code.

We may block access to the site for anyone who does.

Text messages (SMS)

• Program: Clarity Commerce booking and follow-up texts, sent from +1-844-234-5302.
• Consent: you get texts only if you opt in, for example by checking the text message box when you book a call. Opting in is optional and is never a condition of booking a call or buying anything.
• What we send: booking confirmations, reminders and changes, and follow-up about your enquiry.
• Frequency: message frequency varies.
• Cost: message and data rates may apply, depending on your mobile plan.
• Opting out: reply STOP at any time. We'll send one message confirming you're unsubscribed, and then no more.
• Help: reply HELP, or email [email protected].
• Carriers: mobile carriers are not liable for delayed or undelivered messages.
• Changing your number: if you change or give up your mobile number, please tell us so we don't text the new owner.
• Privacy: see the text message section of our Privacy Policy. We never share your mobile number or text consent with third parties for their marketing.

Third-party links and tools

The site links to other websites and uses tools run by other companies, like our booking calendar, forms and video player. Those companies' own terms and privacy policies apply to them. We don't control other websites and aren't responsible for their content.

No warranties

We work to keep the site accurate and running, but it is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties of any kind about the site or its content, including that it will be accurate, complete, uninterrupted, error free or free of viruses, or fit for any particular purpose.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue or data, that come from using or not being able to use the site, the free guide or a free call, even if we were told they might happen.

Our total liability for anything related to the site, the free guide or a free call is limited to $100. Some places don't allow these limits, so they apply to you only as far as your local law allows. Paid work is covered by the liability terms in your signed agreement, not these.

Indemnity

If you misuse the site or break these terms and someone makes a claim against us because of it, you agree to cover our reasonable costs, including legal fees, of dealing with that claim.

Governing law and where disputes go

These terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. Any dispute about the site or these terms will be brought only in the state or federal courts located in Wake County, North Carolina, and you and we both agree to those courts' jurisdiction.

Changes and general terms

We may update these terms from time to time. When we do, we'll post the new version here and change the date at the top. If you keep using the site after that, the new terms apply.

If any part of these terms can't be enforced, the rest still applies. If we don't enforce a part of these terms right away, we haven't given up the right to enforce it later. These terms and our Privacy Policy are the whole agreement between you and us about using the site.
